Stoke Inventory Partners Inc. (“Stoke”, “we”, “our”, ”us”) respects each individual’s right to privacy. By accessing and using the Stoke website at www.stokeip.com or any other web-based service of Stoke via one or more of the following method(s), you are confirming your acknowledgement and acceptance of this Privacy Policy: i) by applying to any product or service in paper (offline); ii) by using an electronic device or equipment which Stoke may designate to access and/or apply to any of its products or services; and iii) by telephone, to communicate with a Stoke representative, you acknowledge and accept the terms in this Policy. 

  1. Purposes of collecting personal information

Unless the purposes for collecting personal information are obvious and you voluntarily provide your personal information for those purposes, Stoke may collect your personal information when you apply for any of our products or services. 

Personal information that Stoke collects from you includes, without limitation: 

  • Your name and address and other contact information, such as telephone numbers, email address; 

  • Information about your transactions with us, such as account numbers, account balances, payment history; 

  • Credit and reference information, such as your date of birth, employment information, driver’s license, previous addresses, and general financial information; 

  • Your bank information for pre-authorized payments. 

When you apply for a product or service, we will make you aware of the purposes for which we are requesting your personal information. If we identify other purposes for which your personal information may be used, we will seek your consent prior to such use. We will advise you that it is your right to refuse permission for Stoke to use your personal information for any new purposes. Additional purposes for collecting your personal information may be identified before or at the time of collection. However, at a minimum Stoke will collect your personal information for the following purposes:

  • To determine your eligibility for our products or services; 

  • To assist us in updating your creditworthiness and the collection of accounts; 

  • To respond to your inquiries about our products and services; 

  • To prevent fraud with respect to both you and our company; 

  • To meet legal, regulatory and settlement requirements.

Sign-on feature: You can select to have a cookie securely store your username to our website. This allows you to access your accounts faster and more conveniently. You cannot store your passwords.

Authenticating your computer: We use cookies to gather information such as IP Address and Browser type to authenticate you and your computer.

Unless you voluntarily provide your personal information for your intended purposes, your knowledge and consent are generally required for the collection, use or disclosure of your personal information and Stoke will seek to obtain consent before or at the time when we collect, use or disclose your personal information.

You can provide consent to the collection, use and disclosure of your personal information expressly or implicitly. However, Stoke will collect, use or disclose personal information about you without your knowledge and consent only in limited circumstances and as permitted by law, such as in the case of an emergency where the life, health or security of an individual is threatened.

Subject to certain legal and contractual restrictions and reasonable notice, you can refuse or withdraw your consent to the collection, use or disclosure of your personal information at any time. Please note that you cannot withdraw your consent to the collection, use and sharing of your personal information if:

  • We are legally required to collect, use or share your personal information;

  • It relates to a credit product we have granted to you where we are required to collect and exchange your personal information on an ongoing basis with credit bureaus, credit insurers and other lenders.

All existing customers will be informed of what types of personal information have been collected, the purpose for the collection and the procedures available for contacting Stoke with any inquiries.

We limit the amount and type of personal information that we collect from you to that which is necessary for the business of the organization and as permitted by law. Each affiliate of Stoke, if applicable, will be responsible for its own collection, use and disclosure of information. 

Personal Information will be collected using procedures that are fair, transparent and lawful. 

  1. Limiting Use, Disclosure and Retention

We will only use your personal information for the purpose for which it was collected as identified above, unless consent is given by you to use or disclose it for another purpose or as is required by law. We use your personal information to set up, manage and provide ongoing services for the products and services that you request and to meet our legal obligations.

  • Comply with laws and regulations that apply to us;

  • Decide whether you are eligible for our products and services;

  • Collect a debt or enforce an obligation owed to us by you;

We will develop explicit retention periods for closed accounts, after which your personal information will be destroyed or made anonymous. Under certain exceptional circumstances, we may have a legal duty or right to disclose your personal information without your knowledge or consent.

We may share your information with third parties for the purposes described below.

There may be instances where we share your information with our related companies in order to serve you better, for data processing, to prevent and detect criminal activity, and to enable our related companies to meet global regulatory, legal or other reporting obligations. We may share your information with other third parties under the following circumstances:

  • To legal counsel representing us;

  • For the purpose of collecting a debt owed to us;

  • To comply with a request, inquiry or order from lawful authorities or court;

  • To an investigative body(-ies) or to government agencies;

  • To process your information in foreign countries as an integral part in the delivery of our service and provide access to law enforcement and national security authorities of that jurisdiction;

We shall take all reasonable steps to ensure that your personal information will be kept accurate, complete and up to date. You may challenge the accuracy and completeness of your personal information and have it amended, as appropriate.

In executing its responsibilities with respect to the confidentiality of your personal information, we will employ a number of safeguards, appropriate to the sensitivity of the information, to protect personal information against loss or theft, as well as unauthorized access, disclosure, copying, use, or modification. Such safeguards will include physical measures, organizational measures and technological measures, for example locked filing cabinets, restricted access to offices, security clearances, limiting access on a “need to know” basis and the use of passwords and encryption. Procedures for implementing these measures will be communicated to all employees and third parties to ensure compliance with this principle.

We keep or will keep our customers informed of these policies and practices and you and Stoke’s customers shall be provided access to all related policies and procedures via Stoke web page and contract terms and conditions. The information is or will be available in a format that is easy to understand. 

  1. Individual Access and Correction

We are committed to maintaining the accuracy of your personal information and ensuring that it is complete and up-to-date.

You may access personal information we hold about you, or ask us to correct any error or delete the information we have about you. We require a written request along with a copy of government issued identification. To protect your privacy, we need to verify your identity before we can provide you with access to, or change, information about you. Do not send any access and correction requests to us via email, as it is not a secured method. We cannot accept any emailed requests.

Unless there are extenuating circumstances, we will respond to your request within 30 calendar days. If we are unable to fulfill your access or correction request due to any legal or regulatory restrictions, we will advise you.

  1. Appeals Process and Contact Information

Any of our customers may challenge our compliance with this Privacy Policy by contacting us directly. Stoke has policies and procedures to receive, investigate and respond to individuals’ complaints and questions.
